Glossary


We want to make it as easy as possible for you to do business with us.
We try and use plain english wherever we can.  Unfortunately the law
like any other industy has its own language and we can't always promise
that we won't be using words that are second nature to us, but may not
be second nature to you.

To help you find your way around the maze of legal terminology we've
provided you with a short glossary of some of the legal terms which you
are more likely to come across in our correspondence and documentation.

Our list, some of which is adapted from www.nolo.com is not exhaustive
as we have not intended to provide a detailed legal dictionary.  There are
a number of other excellent websites however which will assist you should
you need any further explanations beyond those in our glossary.

Balloon payment A large final payment due at the end of a loan typically a car or equipment loan to pay off the amount that your monthly payments had not already covered.


Bankruptcy A legal proceeding that relieves you of the responsibility of paying your debts or provides you with protection whilst attempting to repay your debts.


Barrister A legal practitioner who is by law limited to advisory work or conducting or presenting proceedings before a Court, including the preparation for such proceedings, in any field of the law.


Beneficiary A person or organisation legally entitled to receive benefits through a legal device such as a Will, Trust or Life Insurance Policy.


Bill of Costs An account for legal services showing the work done, and the charges allocated.


Breach of Contract A legal claim that one party failed to perform as required under a valid agreement with the other party.


Brief A document prepared by a solicitor to be provided to a Barrister who will appear for you in a court case. The brief will include the solicitor's observations in relation to the nature of the case as well as the solicitor's comments on relevant documents. All relevant documents are also included. A Barrister is entitled to charge a brief fee once the brief has been delivered to him/her.


By-Laws Rules made by a public authority such as a local Government body or statutory corporation for regulating statutory authorities, associations or clubs. Clients will more commonly see By-Laws used in the context of Strata Title and Community Title developments. The By-Laws regulate the behaviour of the residents of the Strata or Community Scheme.
