Glossary


We want to make it as easy as possible for you to do business with us.
We try and use plain english wherever we can.  Unfortunately the law
like any other industy has its own language and we can't always promise
that we won't be using words that are second nature to us, but may not
be second nature to you.

To help you find your way around the maze of legal terminology we've
provided you with a short glossary of some of the legal terms which you
are more likely to come across in our correspondence and documentation.

Our list, some of which is adapted from www.nolo.com is not exhaustive
as we have not intended to provide a detailed legal dictionary.  There are
a number of other excellent websites however which will assist you should
you need any further explanations beyond those in our glossary.

Family Trusts See 'Trust'.


Federal Court A court established under Commonwealth Legislation which deals generally with disputes relating to Commonwealth Legislation but which can involve parties from the one State. The Federal Court has its own Appeal Court and any appeal from that court in turn is dealt with by the High Court.


File The collection of correspondence and documents relating to a particular matter; OR The act of lodging documents in a Court Registry, each document being signed and sealed by the Court.


File Number A number given by the court registry to a law suit. Also known as the matter number. Lawyers also for internal administrative purposes allocate file numbers to their files.


Filing Fee A fee charged by court registries to accept a document for processing. Filing fees are payable to submit Statements of Claim, a Summons, Notice of Motion, Subpoena and other such documents to the court.


Fishing Expedition Legal grasping at straws. The use of pre-trial investigation such as discovery in an unfocused attempt to uncover damaging evidence to be used against the other party.


Foreclosure The forced sale of real estate to pay off a loan on which the owner of a property has defaulted. This normally occurs by way of a mortgagee sale.


Fraud An intentional dishonest act or omission done with the purpose of deceiving. Fraud includes lies and half-truths, such as selling a lemon and claiming she runs like a dream.
