Glossary


We want to make it as easy as possible for you to do business with us.
We try and use plain english wherever we can.  Unfortunately the law
like any other industy has its own language and we can't always promise
that we won't be using words that are second nature to us, but may not
be second nature to you.

To help you find your way around the maze of legal terminology we've
provided you with a short glossary of some of the legal terms which you
are more likely to come across in our correspondence and documentation.

Our list, some of which is adapted from www.nolo.com is not exhaustive
as we have not intended to provide a detailed legal dictionary.  There are
a number of other excellent websites however which will assist you should
you need any further explanations beyond those in our glossary.

QC The abbreviation for Queen's Counsel, and refers to a Senior Barrister. From 1993 the NSW Government no longer appoints QCs. Those previously appointed retain the title. Senior barristers are now known as Senior Counsel or SCs.


Quantum Meruit The reasonable value of services provided which a party may be able to recover from the other party who is found to have broken a contract. If the first party has done work and has not been paid for it, even though the contract has not finished that party is entitled to a reasonable fee for the work done.


Quiet Enjoyment The right of an property owner or tenant to enjoy his or her property without interference. Disruption of quiet enjoyment may constitute a nuisance. Leases and rental agreements often contain a covenant for 'Quiet Enjoyment' expressly obligating the landlord to see that the tenants have the opportunity to live and/or conduct their businesses undisturbed.


Quorum The minimum number of persons required to carry out a valid meeting. The Quorum is set out in a particular organisation's rules relating to meetings.
